The plaintiff Malco, Inc. sued on contract for the failure and refusal of the defendant Midwest Aluminum Sales, Inc. to pay the balance due on the purchase of aluminum windows. The answer denied the balance was due because the plaintiff had overcharged for windows during the term of the contract. Two counterclaims were pleaded, one for the amount of the overcharges, and the other for compensatory and punitive damages on the ground the plaintiff maliciously and intentionally injured the business credit of the defendant by sending a false letter to the effect the defendant intended to cheat and defraud its creditors. The plaintiff denied these allegations and claimed the contract had been breached by the defendant.
